On August 3, 2025, a significant legal development has emerged in a land fraud case involving a valuable parcel in Nairobi West. A fraudulent court order issued by Gad Chemoiyai on February 27, 2025, favoring Shaba Trustees Limited, a shell company, has been challenged.

COMPANY OF FRAUD: Shaba Trustees Limited Ownership Structure
The company’s directors – Dinah Jelimo Chelagat, Brian Kiptoo Kiplagat, and Cornelius Kipruto—along with former Lands Commissioner and ex-Baringo Central MP Sammy Silas Komen Mwaita, are accused of forging ownership documents to illegally seize the property, identified as Land Reference No.209/9968 IR No.85847, valued at over Ksh. 150 million.

Fraudulent Court Order Engineered By Sammy Mwaita And Associates
The fraudulent order mandated the eviction of the rightful owner from L.R. Number 209/9968 along Mbagathi Way, enforced violently with hired goons – a tactic echoing actions of Kileleshwa MCA Robert Alai.
The use of hired goons as a strategy to seize lucrative properties and parcels of land in Nairobi by Kileleshwa Ward MCA Robert Alai and Sammy Mwaita reveals striking similarities, both relying on violent enforcement to intimidate rightful owners and bypass legal processes.

Alai has been linked to aggressive evictions in upscale neighborhoods, employing thugs to execute forceful takeovers, while Mwaita’s recent case involving Shaba Trustees Limited saw goons enforcing a fraudulent court order on L.R. Number 209/9968.
Such operations require meticulous coordination, access to insider information, and protection from legal repercussions, which cannot occur without top connections.
The involvement of political figures, judicial insiders, and enforcement networks – evidenced by Mwaita’s ties to William Ruto and Alai’s political influence – suggests a well-orchestrated syndicate with high-level backing, enabling them to operate with impunity and exploit Nairobi’s valuable real estate market.
The eviction notice was served on September 25, 2024, by court process server Timon Kipkemei Rotich via WhatsApp (+254733489924), as confirmed by an affidavit.

The Fraudulent Court Process Service Affidavit
However, the presentation of original ownership documents spanning over 30 years led to the order’s reevaluation.
On June 11, 2025, detectives arrested Mwaita at Kilimani, following ODPP directives.
The charge sheet, drafted on the same date, lists multiple offenses: conspiracy to commit a felony (Section 393 of the Penal Code), making a document without authority (Section 357(a)), abuse of office (Section 101 read with 102(a)), and giving false information to public servants (Section 129(a)).
The particulars detail that between March 30, 2001, and March 18, 2020, Mwaita, as Commissioner of Lands, facilitated fraudulent land title registrations for plots along Langata Road and Mai Mahiu Road, targeting the rightful owner and Micugu Wagatharia.
He is accused of deceiving police, including Service No.80936 Sergeant Nicolaus Osuri Otieno, with false information about the land’s ownership, leading to wrongful arrest recommendations.
Shaba Trustees Limited, registered on September 1, 1998, with a nominal capital of Ksh. 100,000,000, shows Dinah Jelimo Chelagat holding 996 shares and the others one each, raising questions about its legitimacy.
The DCI continues to search for Mwaita’s accomplices.
Historical Cases of Corruption Linked to Mwaita
Mwaita’s involvement in this case is not his first brush with corruption allegations. In 2012, he was implicated in a bribery scandal within the Ministry of Lands, allegedly accepting Ksh. 5 million to expedite land title processing for a private developer in Nakuru, a case that was quietly dropped due to lack of prosecution.
In 2018, he faced scrutiny over the irregular allocation of public land in Eldoret, valued at Ksh. 200 million, to a company tied to his political allies, with investigations stalling after key witnesses withdrew their statements.

CRIMINAL MASTERMIND: Sammy Mwaita Leaving EACC Offices After Being Questioned In 2018
In 2021, Mwaita was linked to a procurement fraud case involving the misallocation of Ksh. 30 million for a fictitious land survey project.
Additionally, Mwaita’s name surfaced in a high-profile case involving William Ruto and Joshua Kulei, concerning the fraudulent sale of Ngong Forest land to the Kenya Pipeline Company for Sh272 million between August and September 2001.
Mwaita, as Lands Commissioner, was accused of abuse of office for consenting to the transfer, with claims that Ruto received Sh96 million.
A Nairobi court acquitted all three in April 2011 due to insufficient evidence, notably the absence of key witness Hellen Njue, later appointed by Ruto to a parastatal board, suggesting possible interference.
During his tenure as Agriculture Minister, William Ruto appointed Hellen Njue, a key witness in the Ngong Forest Kenya Pipeline fraud case, as a parastatal board member of the Coffee Development Fund, a move that raises serious concerns about judicial coercion.
Njue’s withdrawal from testifying in the 2011 trial, which acquitted Ruto, Sammy Mwaita, and Joshua Kulei due to insufficient evidence, followed by her appointment, suggests a calculated effort to silence or reward her, undermining the judicial process.
This appointment smirks of influence peddling, casting doubt on the integrity of the initial acquittal and highlighting how political power can be wielded to manipulate legal outcomes, eroding public trust in the judiciary.
This led to Ruto’s 2010 Cabinet suspension, upheld by the High Court, though the case was reopened by the DCI in 2020.
Mwaita’s Extensive Network of Influence
Another image depicts him at the Musalia Mudavadi Centre, flanked by ANC party members, suggesting alliances with current political heavyweights.
Mwaita’s network extends beyond politics. His collaboration with Shaba Trustees Limited’s directors, who hold strategic shares, points to a web of business associates.

The appointment of Hellen Njue, a key witness in the Ruto case, to a parastatal board by Ruto after her withdrawal from testimony, and the involvement of goons like Robert Alai’s land-grabbing maneuvers in similar eviction tactics, suggest a coordinated effort involving political, judicial, and enforcement networks.
His past roles and public engagements, such as with ANC leaders, reinforce his entrenched influence, enabling him to navigate legal challenges and maintain influence, allowing such blatant land-grabbing exploits.
